These Terms govern your use of the Fairgo apps and services. By creating an account or using an app, you agree to them. Apple's standard Licensed Application End User Licence Agreement also applies, available at apple.com/legal/internet-services/itunes/dev/stdeula.
Who you are contracting with
Notices under these Terms — from you to us, and from us to you — go to hugomoriceau@icloud.com. A person reads that address.
The operator's registration details are not settled yet. Rather than name a plausible entity, we mark the gap:
TODO-OWNER — the legal entity behind Fairgo: registered name, legal form, registered address, company / commercial-register number, VAT number where there is one. The same entity named in the Privacy Policy.
1. What Fairgo is
Fairgo is a technology intermediary that connects independent drivers with riders. Fairgo is not a transport carrier and does not provide transportation. The transport contract is between the rider and the driver. Fairgo provides the matching technology and charges drivers a technology service fee.
2. Payment
Riders pay using the methods offered in their market — card or cash. Which of the two is available is a property of the market, not a choice we make per trip: card settlement needs our payment partner to operate in the driver's country, and in markets where it does not, Fairgo is cash only. Fairgo does not take custody of ride fares: card payments settle to the driver's own payment account and cash passes directly between rider and driver.
Fairgo charges drivers a technology service fee of 1% of fares. Applicable taxes are added where the law requires. The fee is never added to the rider's fare and is never deducted from a tip — tips go to the driver in full.
The fee is not invoiced and is not deducted trip by trip. It accrues on the driver's account and is recovered from the driver's next card payment, as Fairgo's share of that charge. The amount taken from any single charge is capped at 10% of that charge, so an accrued balance is drawn down across several trips. Across a driver's fares the total taken is 1% and never more.
Where the fee is not charged. Recovery requires a card payment, which requires a payment partner operating in the driver's country. In a market where none does — Morocco among them — the fee rate is 0%: nothing accrues, nothing is owed and nothing is ever collected. If that changes for a market, it applies only to rides booked after the change; no fee is charged retroactively.
3. Driver independence
Drivers are independent contractors, not employees. Specifically: a driver may decline any request without penalty and declines are not recorded against them; there is no exclusivity, and drivers may work with any other platform at the same time; and account actions follow documented rules and may be appealed.
4. Eligibility and verification
Drivers must be legally entitled to carry passengers for hire in their market and must supply the documents that market requires. Each document is read and checked automatically against the account, and anything that does not pass cleanly is reviewed by a person; an account is activated only once every required document has been approved. Riders must be 16 or older.
5. Acceptable use and safety
Use Fairgo lawfully, give accurate information, and follow the in-app safety rules. We may suspend or close an account for fraud, safety violations, or breach of these Terms, following a documented process you can appeal.
6. Availability
Fairgo opens market by market after the local rules for private-hire transport have been checked, and is unavailable where the model is not permitted. Features vary by market to comply with local law. We do not guarantee that a driver will be available at any given moment.
7. Liability
The service is provided "as is" to the extent the law allows. Because Fairgo does not provide transportation, it is not liable for the conduct of drivers or riders during a trip. Nothing in these Terms limits rights that cannot be limited by law, including any statutory consumer rights you have where you live.
8. Drivers: how offers are ranked, and what happens before an account is restricted
A driver using Fairgo is a business user of an online intermediation service. In the EU that brings duties under Regulation (EU) 2019/1150, and these are ours. They are stated here rather than in a separate document because there is one product and one set of rules.
8.1 Ranking
Dispatch has one main ranking parameter: distance from the pickup point. When a ride is requested, the offer goes to the nearest driver who is online, active, and not already on a trip, within a radius of the pickup. That driver has 45 seconds; if they do not answer, or decline, the offer moves to the next-nearest driver who has not already refused it. Nothing else is ranked: there is no acceptance rate, no rating threshold, no seniority, no paid placement, and no way for a driver to pay for better placement. Declining does not move a driver down — declines are not recorded against anyone.
Where a market allows a rider to hail a specific driver directly, the rider chooses the driver from those nearby; the ordering shown is again distance.
8.2 Restriction, suspension and termination
If we restrict or suspend a driver's account we give a statement of reasons — the specific grounds, and the facts we relied on — at the time it takes effect. If we terminate an account we give at least 30 days' notice and the reasons, unless a legal obligation, a safety risk, or repeated serious breach requires us to act sooner. A driver may contest any of these by replying to the notice; a person reviews it, and we answer in writing.
8.3 Complaints
Any driver complaint about the service can be sent to the contact address in section 10. We do not operate a formal internal complaint-handling system in the sense of Article 11, because as a small enterprise we are exempt from that requirement — the address above is the route, and a person answers it.
9. Governing law and disputes
TODO-OWNER — the governing law of these Terms and the courts that hear a dispute. This has to match the entity named at the top and cannot be picked independently of it.
Whatever is chosen there, it does not take away rights you cannot be deprived of. If you are a consumer in the EU you keep the protection of the mandatory rules of your own country and you may bring proceedings in the courts where you live. If you are a consumer elsewhere, the same applies wherever your local law says so.

These Terms describe how Fairgo actually operates. They are not legal advice, and the obligations that apply to private-hire transport differ by country and city — where local law requires something different, local law governs.
